Dear friends,

Here's a new reason for optimism about the growing public acceptance of libertarian ideas.

A few months ago I wrote about a report by the libertarian Cato Institute that examined years of polling results to try to determine what percentage of Americans were libertarians, or more libertarian than anything else.

That study found that roughly 15 percent of Americans could be categorized as (very broadly) libertarian, based on their answers to a few questions that pollsters have used for years to distinguish a broadly libertarian view. (That 15 percent, incidentally, is very close to results we've found using our World's Smallest Political Quiz.)

Now the follow-up. After publishing that study, Cato commissioned Zogby International to ask the same kinds of questions to 1,012 voters in the 2006 election. Once again, 15 percent of them fell into the broadly libertarian category.

However, Cato's earlier research had found that only a small percentage of respondents with libertarian-leaning views actually used the word "libertarian" to define themselves.

Aware of this, Cato added two more questions to their new poll. They asked half of the sample group, "Would you describe yourself as fiscally conservative and socially liberal?"

And they asked the other half, "Would you describe yourself as fiscally conservative and socially liberal, also known as libertarian?"

"The results surprised us," Cato vice president David Boaz reports. "Fully 59 percent of the respondents said 'yes' to the first question. [59 percent] said they would describe themselves as 'fiscally conservative and socially liberal.'

"The addition of the word 'libertarian' clearly made the question more challenging. What surprised us was how low the drop-off was. A robust 44 percent of respondents answered 'yes' to that question, accepting a self-description as "libertarian."

Boaz correctly notes that the question is "over-inclusive." Libertarianism, of course, is more than just "fiscally conservative and socially liberal." It's the belief that individuals have the right to do as they wish with their own lives and property, as long as they don't harm others or their belongings.

But I agree with Boaz, who concludes:

"Still, it's encouraging that 59 percent of Americans think they lean in a libertarian direction on both economic and social issues -- and that 44 percent are willing to be described as libertarian.

"And that 59 percent interestingly matches a Los Angeles Times poll that found that Americans preferred "smaller government with fewer services" to "larger government with many services" by 59 to 26 percent."

I can tell you from decades of experience that public understanding of, and respect for, libertarian ideas is at an all-time high. This is definitely a time of emergence for libertarianism -- and that is exciting.

Maine Leads States' Rebellion Against National ID Act

 

In a welcome slap in the face to the federal War On Privacy, Maine has become the first state in America to reject the federal "Real ID Act of 2005."

The Maine Senate and House approved almost unanimously a joint resolution saying the body "refuses to implement the Real ID Act" and urging Congress and the President to repeal it. Copies were sent to President Bush, Department of Homeland Security head Michael Chertoff, and other federal officials.

Similar measures will shortly be taken up by other states. Grassroots opposition to the Real ID scheme is large and growing.

Real ID requires states to turn their driver's licenses into national ID cards that will be part of a 50-state shared database, containing personal information on each driver. The cards would also be computer-readable, allowing government and private scanners to collect the personal information on the cards.

As libertarian congressman Ron Paul (R-TX) has said: "This Real ID Act establishes a massive, centrally-coordinated database of highly personal information about American citizens: at a minimum their name, date of birth, place of residence, Social Security number, and physical characteristics. The legislation also grants open-ended authority to the Secretary of Homeland Security to require biometric information on IDs in the future. This means your harmless looking driver's license could contain a retina scan, fingerprints, DNA information, or radio frequency technology."

Maine lawmakers object to both the cost of Real ID and the threat to privacy. Senate Majority Leader Libby Mitchell, sponsor of the resolution, said, "The federal government may be willing to burden us with the high costs of a program that will do nothing to make us safer, but it is our job as state legislators to protect the people of Maine from just this sort of dangerous federal mandate. ... I am proud that this state has led the way in taking a stand against Real ID."

The Maine Democratic Party noted that, if Real ID becomes law, "The card that was once used to prove an individual was safe to drive will now be used as an 'internal passport' that can be used to track an individual's movement and activities."

The ACLU has added that the Real ID "will become tantamount to a license to leave your house," since it will be required virtually everywhere you go. "The end result could be a situation where citizens' movements inside their own country are monitored and recorded through these 'internal passports.'"

The federal government has pushed for a national ID card for years, well before the 9/11 terrorist attacks. Previous justifications have included health care, the War on Drugs, and controlling immigration. Any excuse, it seems, will do.

Ultimately Real ID must be stopped at the federal level. Hopefully this grassroots, state-by-state opposition can make that happen.

U.S. Attorney General: WHAT Right to Habeas Corpus?


The following exchange between U.S. Attorney General Alberto R. Gonzales and U.S. Senator Arlen Specter (R-PA) took place during a meeting of the Senate Judiciary Committee on January 17, 2007.

As the Washington Post noted, the view Gonzales states here "has raised some eyebrows in legal circles." To say the least.

The Latin term "habeas corpus" refers to the centuries-old right of prisoners not to be arrested and imprisoned in secret, and to see the evidence for any arrest. The right is widely considered the cornerstone of liberty, and it dates back at least to the Magna Carta of the year 1215. British violations of the habeas corpus rights of Americans were a leading cause of the American Revolution.

Without this basic protection, a government by definition becomes a tyranny. According to many analysts, the Bush administration effectively took away the U.S. right to habeas corpus -- or at least severely weakened it -- with the passage of the "Military Commissions Act of 2006," as we covered in our October 5, 2006 issue (Vol. 11, No. 20).

Article I, Section 9, Clause 2 of the Constitution states: "The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it."

Here's a partial transcript of the now-infamous January 17 exchange between U.S. Attorney General Gonzales and Senator Specter:

Gonzales: The fact that the Constitution -- again, there is no expressed grant of habeas in the Constitution. There's a prohibition against taking it away. But it's never been the case. I'm not aware of a Supreme...

Specter: Now wait a minute. Wait a minute. The Constitution says you can't take it away except in case of rebellion or invasion. Doesn't that mean you have the right of habeas corpus unless there's an invasion or rebellion?

Gonzales: I meant by that comment, the Constitution doesn't say every individual in the United States or every citizen is hereby granted or assured the right to habeas. Doesn't say that. It simply says the right of habeas corpus shall not be suspended except . . .

Specter: You may be treading on your interdiction and violating common sense, Mr. Attorney General.

Gonzales: Um.

Tax Collectors Kill Citizen Astronaut's Dream

Space buff Brian Emmett has wanted to be an astronaut since childhood. As a kid he attended space camp and watched shuttle launches from Kennedy Space Center.

His lifelong dream was on the way to becoming reality when he won a 2005 sweepstakes by Oracle Corporation. The prize: a reservation for a free trip to outer space, to be provided by Space Adventures Ltd., a private company that books multi-million dollar trips into space on Russian rockets.

However, Emmett won't be on board when his rocket ship blasts off -- thanks to the IRS.

He discovered the trip -- valued at $138,000 -- would have to be reported as taxable income. As a result, he would owe $25,000 in taxes.

Unable to pay that amount, and not willing to go into debt for it, he abandoned the prize.

He was devastated.

"There was definitely a period of mourning. I was totally crestfallen. Everything you had hoped for as a kid sort of evaporates in front of you."

Other companies that offer similar space-flight contests have provided checks to cover taxes -- but those checks, too, count as taxable income.

Emmett's loss is just one very dramatic example of how taxes damage and limit the lives of citizens. How many millions of dreams, large and small, are destroyed by voracious taxes every year? How many opportunities are passed up, or never come into being? How many lives are diminished and stunted? How many wings are clipped?

MILTON FRIEDMAN EXPLAINS GOVERNMENT SPENDING: January 29 was Milton Friedman Day, created to celebrate the late, great libertarian economist. Andrew Moylan of the National Taxpayers Union shared this Friedman quote that explains government spending in a mere 155 words:

"There are four ways in which you can spend money. You can spend your own money on yourself. When you do that, why then you really watch out what you're doing, and you try to get the most for your money. Then you can spend your own money on somebody else. For example, I buy a birthday present for someone. Well, then I'm not so careful about the content of the present, but I'm very careful about the cost. Then, I can spend somebody else's money on myself. And if I spend somebody else's money on myself, then I'm sure going to have a good lunch! Finally, I can spend somebody else's money on somebody else. And if I spend somebody else's money on somebody else, I'm not concerned about how much it is, and I'm not concerned about what I get. And that's government. And that's close to 40% of our national income."

"It's the Government, Smarty!"

"Policy wonks." "Academics and intellectuals." "The best and the brightest." That's how the 1992 Clinton for President insiders and core campaign team saw themselves.

They lived and breathed academic white papers and public policy reports. They regularly got lost in the details.

Until James Carville and Paul Begala found their campaign mantra: "It's the Economy, Stupid!"

"The economy" was *the* crucial issue for the 1992 Clinton for President Campaign.

Whenever Bill Clinton or his campaign team got distracted or detoured by other issues, Carville or Begala would repeat the campaign mantra: "It's the Economy, Stupid!" A simple and direct message for bright and complex people.

That message, that issue, took Bill Clinton to the White House.

And it's a lesson for us -- if we have the wisdom to adapt and apply it.

The libertarian movement is filled with bright and thoughtful individuals. "Policy wonks." "Academics and intellectuals." "The best and the brightest."

When libertarians discuss politics and government, we often get lost in the details. And so do our listeners.

Complexity confuses. Simplicity enlightens.

To reach the hearts and minds of Americans, we must distill our issue down to its essence. We must simplify.

Our issue, our mantra is this: "It's the Government, Smarty!"

Government involvement is the issue. The costs and consequences of government involvement.

We must describe and define the government's role and function in each and every proposal, policy, or program.

Consider a few broad examples.

Social policy. Economic policy. Public policy. Economic programs. Social programs. Public funding. Regulation. Single-payer. Central planning. Public schools.

What's missing? The fact that government is the indispensable, distinguishing feature of each. Government funding. Government compelling or forbidding. Government regulating or controlling. Government managing or owning.

What happens if we speak the unspoken? Mention the unmentioned? Make the implicit explicit?

What happens if we define them as government proposals, government policies, and government programs?

Government Social Policy. Government Economic Policy. Government Policy. Government Economic Programs. Government Economic Programs. Government Funded. Government Regulation. Government-Payer. Government Central Planning. Government-run Public Schools.

Their appeal fades. Their attraction shrivels. Their popularity plummets.

Why? Because of government's record and reputation. Because people have seen government's incompetence, irresponsibility, unaccountability, malfeasance, misfeasance, cover-ups, dishonesty, massive overspending and overtaxing, waste, damage, and harm.

Because people know that government regularly repeats its follies and fails to learn from its failures.

We do not trust government.

This is why the word "government" is artfully removed from the proposals, policies, and programs.

This is why the words "public" or "social" are substituted.

This is why the word "government" is amputated from the words "social" or "economic" or "regulation."

You can make huge headway by simply putting the word "government" where it belongs. By describing and defining the idea as a government proposal, government policy, or government program. By insisting that it be shown and seen as government.

Once you do that, most people will look at the issue with new eyes. Many will become receptive and responsive to your free market, small government, libertarian alternative.

Just remind yourself, "It's the Government, Smarty!"

Could open borders make us safer?

QUESTION: In the current fight over global terrorism, how can some libertarians justify promoting an open border policy?

MY SHORT ANSWER: I appreciate your concern. Many people fear that terrorists will be able to get into our country more easily if we loosen immigration restrictions. However, the opposite may actually be true.

For example, the alleged lead 9-11 hijacker Mohamed Atta entered the United States three times on an expired tourist visa in 2001, even though officials were aware that he violated its terms by taking flight lessons. Did immigration officials overlook Atta and the threat he posed because they were too busy sending job-seeking Mexicans back to their homeland? If immigration officials focused on excluding terrorists instead of peaceful people, wouldn't we be safer?

The only legitimate purpose of government is the protection of our life, liberty, and property. Consequently, government has the right, if not the duty, to stop those who would harm us from doing so. However, every dollar spent trying to stop peaceful activity, including immigration, is one less dollar spent on making sure that terrorists don't get to us.

No matter who you're talking to about libertarianism, chances are good that he is listening to a radio station in his head -- WII-FM.

The call letters stand for "What's In It For Me?". And WII-FM is the most popular station in town!

When we learn about something new -- a product *or* an idea -- it's natural to wonder if it will be good or bad for us.

"How will this affect me, my family, my friends?" is a very sensible question to ask about any new idea. It's only natural that people will wonder this about libertarianism, too.

Next time you're discussing an issue with someone, try answering that question for your listener -- before it's even asked.

Examples:

"If we ended the income tax, YOU would have several thousand dollars more in your pocket, to spend, save, or contribute to your favorite cause."

"If we ended the Drug War, YOUR children would be safer because we would halt gang violence in our streets."

Libertarians have all the facts on our side. We know that liberty works -- that liberty has the best answers to the world's problems. Learn those facts -- and learn to personalize them.

Remember, your listener is tuned in to WII-FM. Try this tip, and chances are very good that libertarianism will rise to the top of WII-FM's hit list! .
